Can an association charge a fee for the resale certificate and require payment at the time the certificate is requested?

 

Yes. Pursuant to Sec. 55.1-2316(a), an association may charge a fee for the resale certificate and may require payment at the time the certificate is requested. Realtors® should inform their seller-clients of this obligation as an estimated cost of listing their property.  

Also, please remove the duplicative FAQ titled, “The parties agreed to amend the Residential Sales Contract to remove all requirements on Seller to comply with POA or COA’s notices of violations related to the physical condition of Property. To accomplish this change, the parties signed Paragraph 2(B), Checkbox #5 of the Contingencies/Clauses Addendum (K1344). Later, Buyer discovered in the resale disclosure packet that Seller received a notice of violation for failure to pay association dues. Is Seller responsible for the unpaid dues?
