DC Order on CDC

On May 5, 2021, U.S. District Court Judge Dabney Friedrich of the District of Columbia ruled that the CDC exceeded its authority last year when it enacted a nationwide eviction moratorium. The Georgia and Alabama Association of REALTORS® joined housing providers and their property management companies in the lawsuit to protect struggling small-business owners and firms impacted by the lack of rental income. NAR’s response to the ruling is available for review here.  

The Department of Justice filed an emergency appeal and the court agreed to temporarily stay the ruling.  

Regardless of what happens on appeal, this ruling will not impact existing Virginia protections for tenants facing evictions for non-payment of rent or the Virginia Rent Relief Program. See our Government Affairs Team’s write-up on these protections here.
